These Terms of Service ("Terms") govern your access to and use of k4elite.com (the "Site") and any products you purchase from K4 Elite ("we," "us," "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or purchase our products.
You must be at least 18 years old and a qualified research professional or purchasing on behalf of a research institution. By ordering, you represent that you have the legal capacity and authority to enter into these Terms and to handle research materials safely and lawfully.
All products are sold exclusively for in-vitro research and laboratory experimentation. They are not drugs, food, cosmetics, or supplements, are not for human or veterinary use, and are not intended to diagnose, treat, cure, or prevent any disease. Our products have not been evaluated by the FDA.
You alone are responsible for determining any research protocol, handling, storage, and disposal, and for using the products safely, lawfully, and in an appropriately controlled laboratory setting. K4 Elite does not provide dosing, administration, or usage instructions of any kind.
You are solely responsible for knowing and complying with all federal, state, and local laws and regulations that apply to the purchase, import, possession, handling, and use of these materials in your jurisdiction. Placing an order is your representation that doing so is lawful where you are located.
Your submission of an order is an offer to purchase, which we may accept or decline at our discretion. We may refuse or cancel any order — including for suspected fraud, ineligible use, product unavailability, or pricing errors. After you place an order request, we email you an itemized invoice showing the total, including any shipping and applicable taxes. You then pay using one of the methods shown on the invoice — such as a secure card payment, Zelle, Cash App, Venmo, PayPal, or Apple Pay. Where you pay by card, your card information is processed by a PCI-compliant third-party payment processor; we do not store your full card number on our servers. Please include your order number as the payment memo.
Shipping timeframes, methods, and costs are described in our Shipping Policy, which is incorporated into these Terms. Delivery estimates are not guaranteed, and title and risk of loss pass to you upon our delivery of the package to the carrier.
Returns and refunds are governed by our Returns & Refunds Policy, which is incorporated into these Terms. In short, unopened, untampered items in original condition may be returned within 14 days; opened or reconstituted products are final sale.
You agree not to misuse the Site — including attempting to gain unauthorized access, disrupting its operation, scraping or harvesting data, introducing malicious code, or using the Site for any unlawful purpose.
The Site and its content — including text, product descriptions, graphics, logos, and layout — are the property of K4 Elite or its licensors and are protected by applicable intellectual-property laws. You may not copy, reproduce, or redistribute our content without our prior written permission.
Except for a product's stated Certificate of Analysis, all products and the Site are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
You knowingly and voluntarily assume all risks associated with purchasing and handling research materials. To the maximum extent permitted by law, K4 Elite and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use or misuse of the products or the Site. Our total aggregate liability for any claim relating to a product or order will not exceed the amount you paid for that product.
You agree to indemnify and hold harmless K4 Elite and its owners, employees, and suppliers from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the products, or your violation of any law or the rights of any third party.
These Terms are governed by the laws of the State of Louisiana, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Louisiana, and you consent to their jurisdiction.
We may update these Terms from time to time. Changes take effect when posted, and the "Last updated" date above will reflect the revision. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
